Terms of Service

These Terms of Service ("Terms") govern access to and use of VoteKiosk, a service operated by Inspiration & Trust Inc. ("VoteKiosk", "we", "us"). By creating an account or using VoteKiosk to run or participate in an election, you agree to these Terms.

1. What VoteKiosk provides

VoteKiosk is a software platform that lets an organization ("Client") build a ballot, manage a voter roll, and run an election — remotely, in person, or both — and lets that Client's voters securely access and cast a ballot.

2. Client responsibilities

A Client using VoteKiosk to run an election is responsible for:

• Having the legal authority to run the election, under its own governing rules (bylaws, constitution, or equivalent);
• The accuracy of the voter roll it uploads, including consent to contact each voter by the email address or phone number provided;
• Setting up the ballot, terms, and eligibility rules correctly before opening voting;
• Resolving disputes about the conduct or outcome of its own election according to its own governing rules.

VoteKiosk provides the platform; it does not decide who is eligible to vote, what is on the ballot, or how a dispute is resolved — those are the Client's own decisions.

3. Acceptable use

You agree not to use VoteKiosk to:

• Contact anyone who has not consented to be on a voter roll for a legitimate election;
• Attempt to access another organization's election data or another voter's ballot access;
• Interfere with the secrecy, integrity, or availability of any election running on the platform;
• Use the service for any unlawful purpose.

4. Messaging

One-time codes sent by email or SMS are transactional, sent only in response to a specific voter's own request to access a specific election's ballot, and are not marketing communications. See our Privacy Policy for details on how contact information is used.

5. Availability

We work to keep VoteKiosk available and responsive, particularly during an open election, but the service is provided "as is" without a guarantee of uninterrupted availability. We recommend Clients open voting with a reasonable window rather than a single fixed moment, and use the built-in ballot backup feature before opening a live election.

6. Limitation of liability

To the fullest extent permitted by law, VoteKiosk and Inspiration & Trust Inc. are not liable for indirect, incidental, or consequential damages arising from use of the service, including disputes about an election's outcome, which are governed by the Client's own rules and, where applicable, the law that governs the Client's organization.

7. Changes to the service or these Terms

We may update these Terms as the service evolves. Continued use of VoteKiosk after a change takes effect constitutes acceptance of the updated Terms.
